Sponsorships

1. ASSUMPTION OF RISK
I understand that skateboarding, surfing, snowboarding, any type of riding, demonstrations, competitions, travel, events, and other board-sport activities involve inherent risks, including the risk of serious injury, property damage, or death. I voluntarily accept and assume the risks associated with participation in these activities and agree to follow applicable laws, event rules, safety requirements, and reasonable instructions.

2. EQUIPMENT & PRODUCT USE
Any equipment, products, apparel, graphics, promotional materials, or other items provided by Apex Board & Ride Co. are provided for their intended use and must be used responsibly and in accordance with applicable safety practices. Participants are responsible for determining whether they are physically and otherwise capable of safely participating in any activity, event, demonstration, or other program-related activity.

3. RELEASE OF LIABILITY
In consideration of participation in any Apex Board & Ride Co. sponsorship, partnership, rider, promotional, event, demonstration, photo, video, or related program, and/or receipt or use of any equipment, products, apparel, or other materials provided by Apex Board & Ride Co., I hereby agree that I, on behalf of myself and/or my child, as applicable, as well as my heirs, legal representatives, and assigns, will not make any claim against, sue, or seek damages from Apex Board & Ride Co. LLC, its owners, officers, directors, employees, agents, contractors, representatives, affiliates, or other authorized personnel for any injury, loss, damage, or property loss arising from or related to participation in the program, participation in events or activities, travel associated with program activities, or use of any equipment or products provided, except to the extent such liability cannot legally be waived.

4. INDEPENDENT RELATIONSHIP
Participation in an Apex Board & Ride Co. sponsorship or partnership program does not create an employment relationship, agency relationship, franchise relationship, joint venture, or ownership interest between the participant and Apex Board & Ride Co. unless expressly established by a separate written agreement. Participation does not authorize any participant to make commitments, representations, or agreements on behalf of Apex Board & Ride Co. without prior written authorization.

5. BRAND & CONDUCT
I agree to conduct myself in a manner that does not intentionally damage or misrepresent the reputation, trademarks, products, or business interests of Apex Board & Ride Co. Participation in a sponsorship or partnership program does not provide ownership of or any independent right to use Apex Board & Ride Co. trademarks, logos, copyrighted materials, or other intellectual property except as expressly authorized.

6. PHOTO, VIDEO & MEDIA RELEASE
I authorize Apex Board & Ride Co. LLC and its authorized representatives to photograph, record, film, and otherwise capture my name, image, likeness, voice, appearance, and participation in connection with the Apex Board & Ride Co. Sponsorship / Partnership Program. I grant Apex Board & Ride Co. permission to use, reproduce, edit, publish, display, distribute, and share these photographs, videos, recordings, and related content for marketing, advertising, promotional, social media, website, editorial, and other legitimate business purposes, without additional compensation or further approval.

I understand that I will not have ownership of or approval rights over the resulting photographs, videos, recordings, or other media, and that Apex Board & Ride Co. may use such content in its original or edited form. This authorization applies to media captured during program activities, events, demonstrations, photo shoots, video shoots, competitions, and other activities associated with the sponsorship or partnership program.

If the participant is under 18 years of age, this authorization must be provided by the participant’s parent or legal guardian.

7. PROGRAM CHANGES & TERMINATION
I understand that Apex Board & Ride Co. may establish, modify, suspend, or discontinue sponsorship and partnership programs and may determine eligibility and program participation in accordance with the applicable program terms and any separate written agreement.

8. ACKNOWLEDGMENT & AGREEMENT
I have carefully read this agreement and fully understand and acknowledge its contents. I understand that this is a release of liability and program terms governing my participation in an Apex Board & Ride Co. sponsorship or partnership program. I understand that by checking the applicable box and submitting this agreement, I acknowledge and agree to these terms.

Completion and submission of this application does not constitute an agreement, contract, sponsorship, partnership, endorsement, representation, or other commitment between the applicant and Apex Board & Ride Co. LLC. Submission of this application does not guarantee or imply sponsorship, partnership, discounts, free products, equipment, compensation, royalties, promotional opportunities, event participation, or any other benefit or consideration from Apex Board & Ride Co.

This form is solely an application for consideration for a potential sponsorship and/or partnership with Apex Board & Ride Co. LLC. Any sponsorship, partnership, benefits, compensation, discounts, products, services, responsibilities, or other terms will only become effective if separately approved and established in a written agreement or other written authorization issued by Apex Board & Ride Co. LLC.

Submitting this application does not obligate Apex Board & Ride Co. LLC to approve the application, offer sponsorship or partnership, provide any products or benefits, or enter into any agreement with the applicant.
